Under our state’s Fair Employment and Housing Act (FEHA), as amended by SB 1343, employers with five or more employees must provide harassment prevention training to employees on a regular basis.
Key requirements include:
- Supervisors must receive two hours of sexual harassment prevention training every two years.
- Non-supervisory employees must receive one hour of training every two years.
- New employees generally must be trained within six months of hire, and new supervisors within six months of promotion.
- The requirement applies to employers with five or more employees, including many part-time, temporary, and seasonal workers.
California law also requires the training to address more than just sexual harassment. It includes topics such as abusive conduct (workplace bullying), harassment based on gender identity, gender expression, and sexual orientation, as well as information about reporting and preventing unlawful workplace behavior.
